TERMS AND CONDITIONS OF PURCHASE
By purchasing the Morning Magic Routine (the “Course”) from Alesha McNeill (“Coach”), also known as Alesha Soul on social media, you agree and consent to the following legal terms and conditions that govern your use of the Course and that form a legal agreement between you and the Coach.
PAYMENT
The full price of the Course is $37 USD. You are responsible for paying for the Course in full and for providing Coach with a valid credit card or other payment method at the time of purchase.
If a payment is declined, returned, or deemed fraudulent, your access to the Course will be suspended until the issue is resolved. Multiple missed payments may result in permanent termination of your access to the Course unless all remaining payments are made in full. In the case of non-payment, Coach reserves the right to pursue the full amount owed through a collections process.
REFUNDS
Given the nature of the Course, no refunds will be offered.
PURCHASING REQUIREMENTS
You must be at least 18 years of age or older to purchase this Course.
The Course is available for individual purchase only. Friends, family, partners, colleagues, etc., must each purchase the Course individually. You are expressly prohibited from sharing access to the Course with anyone else. Additionally, you have no right to assign this Agreement as this Course is non-transferable.
EARNINGS DISCLAIMER AND INDIVIDUAL RESPONSIBILITIES
This Course is not a get healthy, happy, healed, or rich scheme. Coach cannot guarantee any specific success or increased income, joy, or healing from taking this Course. Although many students have experienced positive results and shared testimonials, those outcomes are not guaranteed or typical for everyone. Your results depend on many factors, including your dedication, desire, and motivation. You accept the risk of not achieving any results or less than desirable results from participating in the Course.
This Course does not provide professional financial, legal, medical, or psychological services or advice. The Course content does not cure or treat any mental or medical condition. You are solely responsible for your own physical, mental, and emotional well-being, decisions, actions, and results.
Coach disclaims any liability for your reliance on any opinions or advice contained in the Course.
Any third-party links to products or services are subject to separate terms and conditions. Coach is not responsible for or liable for any content or actions taken by such third-party websites. It is your responsibility to fully vet such third parties before entering into any transaction or relationship with them.
INTELLECTUAL PROPERTY
This Course includes materials protected by copyright, trademark, and other intellectual property laws. These materials include, but are not limited to, written text, workbooks, videos, audio recordings, photos, designs, and graphics. Any reproduction or unauthorized use shall constitute infringement. Duplicating, sharing, or uploading Course files to sharing sites is considered theft, and Coach may prosecute such misconduct to the fullest extent permitted by law.
Coach provides you with this Course solely for your personal, noncommercial use. You agree not to use any proprietary information or materials in a manner that violates this Agreement. You may view, download, print, email, and use these materials for your personal use only. You may not republish, reproduce, duplicate, copy, display, distribute, or otherwise use any material from the Course for commercial purposes. Additionally, you may not modify, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works from, exploit, or distribute in any manner or medium, including by email or other electronic means, any material from the Course.
CONFIDENTIALITY
To access certain features of the Course, you may need a username and/or password. You agree to keep this information confidential and not share it with anyone else. If Coach has reasonable grounds to suspect that you have shared your login credentials or forwarded Course materials to another person, Coach reserves the right to suspend or terminate your account and refuse any and all current or future access to the Course or related services, without refund.
PRIVACY
Coach and her third-party vendors may collect information from you when you purchase the Course, complete forms, access private membership pages, or otherwise interact with Coach through online forms, email, or social media. Collected information may include your name, email address, phone number, billing details, and other identifying data.
Coach collects this information to send emails, fulfill orders, deliver services, complete transactions, oversee promotions, and improve customer service.
By purchasing the Course, you will be added to Coach’s email list. You may unsubscribe from general communications at any time via the unsubscribe link, but if you unsubscribe from the Course-related list, you may no longer receive important Course materials.
Coach does not sell, trade, or transfer your personal information to third parties for marketing. Your information may be shared with trusted service providers to assist with website maintenance, payment processing, and communications. Coach may also disclose information when required by law.
Be aware that any comments or information you post in Course-related forums or social groups may be publicly accessible. Coach is not responsible for third-party use of such information.
Coach may collect cookies and domain information to analyze website performance, save user preferences, and customize your experience.
FORBIDDEN ACTIVITIES
You are strictly prohibited from:
- Causing damage to the Course website or private membership site;
- Using the site for any unlawful or harmful purpose;
- Uploading or distributing malware, spyware, viruses, or malicious software;
- Sending unsolicited communications or advertisements;
- Collecting data systematically from the site;
- Sharing copyrighted or proprietary Course materials;
- Sharing your username and/or password with others.
NO INDIVIDUAL COACHING
The Course is a self-study program and does not include individual coaching. Occasionally, Coach may offer optional group calls, but these do not establish a personal coaching relationship.
INDEMNIFICATION
You agree to indemnify and hold harmless Coach and her contractors from any claims, damages, liabilities, costs, or expenses resulting from your violation of this Agreement or applicable law.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
The Course is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Coach disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.
Coach does not warrant that the Course website will be uninterrupted or error-free. You agree that your sole remedy for dissatisfaction is to discontinue use of the Course.
In no event shall Coach be liable for any damages exceeding the amount you paid for the Course. Certain jurisdictions do not allow the limitation of liability for incidental or consequential damages, so this limitation may not apply to you.
ENTIRE AGREEMENT AND SEVERABILITY
This Agreement represents the entire understanding between you and Coach with respect to the Course. If any part of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
The failure of Coach to enforce any part of this Agreement shall not constitute a waiver. Any ambiguity shall not be construed against the drafting party.
